8. Limitation of Liability

To the maximum extent permitted by law, Hot Automations shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Refund Policy

Summary

Digital services and hosting are non-refundable once work or hosting has begun. Hosting is billed separately and may be cancelled at any time, but unused time is not refunded.

This Refund Policy outlines the circumstances under which refunds may or may not be issued for services provided by Hot Automations ("we", "us", "our").

By purchasing or engaging our services, you agree to the terms set out below.

1. Nature of Our Services

We provide digital and professional services, including but not limited to:

  • Website design and development
  • Application development
  • Hosting and deployment services
  • Domain and DNS configuration
  • Technical consultancy, support, and handover services

Due to the bespoke, time-based, and digital nature of these services, refunds are assessed differently from physical goods.

2. No Automatic Right to a Refund

Once work has commenced, there is no automatic right to a refund.

In accordance with UK consumer and contract law relating to digital services:

  • Fees are chargeable for work already completed
  • Time, expertise, and platform resources used are non-recoverable

3. Website & Digital Build Services

3.1 Commencement of Work

A project is deemed to have commenced once any of the following occur:

  • Design or development work begins
  • A project environment or repository is created
  • Code, layouts, or configurations are produced
  • Consultancy, setup, or configuration work is carried out

Once a project has commenced, fees relating to completed work are non-refundable.

3.2 Project Completion

A project is considered delivered once:

  • The website or application has been built and made available for review, testing, or deployment, or
  • The agreed scope of work has been completed

A client choosing not to proceed with hosting, deployment, or launch does not constitute non-delivery.

4. Hosting Services (Separate Service)

4.1 Hosting as a Separate Service

Website hosting is provided as a separate service from design and development unless explicitly stated otherwise.

Hosting fees cover:

  • Platform access and account responsibility
  • Resource usage (including bandwidth, requests, and storage)
  • Availability of the website under our hosting account

Hosting is optional and must be agreed separately.

4.2 Hosting Fees & Billing

Hosting may be billed monthly or annually as agreed at the time of purchase or renewal.

Once a hosting period has begun, fees for that period are non-refundable.

4.3 Cancellation or Termination of Hosting

Clients may cancel hosting at any time by providing written notice.

Upon cancellation:

  • Hosting will end at the conclusion of the current billing period
  • The website may be taken offline unless alternative hosting is arranged
  • No refunds are issued for unused time within the current billing cycle

4.4 Client-Initiated Hosting Changes

If a client chooses to:

  • Move to another hosting provider
  • Self-host the website
  • Appoint a third-party developer or agency

We are not responsible for:

  • Downtime during migration
  • Compatibility issues on new hosting platforms
  • Website availability after hosting ends

4.5 Suspension or Pausing of Hosting

Hosting may be paused or suspended where:

  • Hosting fees expire or remain unpaid
  • Hosting is no longer required
  • Continued hosting would result in unnecessary platform usage

During suspension:

  • The website may become temporarily unavailable
  • No refunds are due for paused or suspended periods

4.6 Fair Use & Resource Limits

All hosting is subject to fair use and platform limitations.

We reserve the right to:

  • Restrict or suspend hosting if usage becomes excessive
  • Require an upgrade or alternative hosting arrangement where appropriate

4.7 Refunds for Hosting

Hosting fees are non-refundable once hosting has commenced.

At our discretion, a partial refund may be considered only where:

  • Hosting has not yet begun, or
  • A billing error has occurred

No refunds are provided for:

  • Active hosting time
  • Partial billing periods
  • Resources already consumed

5. Third-Party Services & Platforms

We are not responsible for delays, outages, limitations, or issues caused by third-party services, including but not limited to:

  • Hosting platforms
  • Domain registrars
  • DNS providers
  • Email service providers

Refunds will not be issued for issues outside of our direct control.

6. Client-Initiated Changes or Cancellation

If a client:

  • Cancels a project after work has commenced
  • Changes hosting providers
  • Decides not to proceed after delivery

All completed work remains chargeable and non-refundable.

Where appropriate, we will provide a reasonable handover of completed assets.

7. Goodwill & Partial Refunds

At our discretion, we may offer:

  • A partial refund
  • A service credit
  • A goodwill adjustment

Any such offer:

  • Is made without admission of fault
  • Is final once accepted

8. What Refunds Do Not Cover

Refunds do not cover:

  • Consultation or support time
  • Setup, configuration, or deployment work
  • Troubleshooting third-party services
  • Administrative or account-related costs

9. How to Request a Refund

Refund requests must be made in writing and include:

  • Project name
  • Reason for the request
  • Relevant dates

Requests are reviewed on a case-by-case basis, and a response will be provided within a reasonable timeframe.
